In the past generation, restitution law has emerged as a global phenomenon. From its Oxbridge home, restitution migrated to the rest of the Commonwealth, and ongoing Europeanization projects have brought the common law of restitution into contact with the Romanist concept of unjust enrichment, further internationalizing this movement. In contrast, in the United States, scholarly interest in restitution, in terms of books, articles, treatises, symposia and courses on restitution, is meager. Similarly, while restitution, equity and tracing cases receive considerable treatment (...) at the highest levels of the English judiciary, US courts seem uninterested in these issues, rarely producing the theory-laden opinions that have become quite common in the House of Lords. The situation is particularly curious because restitution is generally thought to be the invention of late nineteenth-century American scholars. This article explains this divergence. I argue that the Commonwealth restitution discourse is largely a product of pre- or anti-realist legal thought which generates scepticism within the American academic-legal establishment. The article identifies the two dominant camps in American private law thought—left-leaning redistributionalists and the centre-right legal economists—and shows that neither has any use for the Commonwealth's discourse. I conclude by analysing the emerging drafts of the Restatement of Restitution and forecast the future of American restitution law. (shrink)

IntroductionResponsive neurostimulation is an evolving therapeutic option for patients with treatment-refractory epilepsy. Open-loop, continuous stimulation of the anterior thalamic nuclei is the only approved modality, yet chronic stimulation rarely induces complete seizure remission and is associated with neuropsychiatric adverse effects. Accounts of off-label responsive stimulation in thalamic nuclei describe significant improvements in patients who have failed multiple drug regimens, vagal nerve stimulation, and other invasive measures. This systematic review surveys the currently available data supporting the use of responsive thalamic neurostimulation (...) in primary and secondary generalized, treatment-refractory epilepsy.Materials and MethodsA systematic review was performed using the following combination of keywords and controlled vocabulary: OR ) OR [responsive neurostimulation AND thalamus AND ]. In addition, a search of the publications listed under the PubMed “cited by” tab was performed for all publications that passed title/abstract screening in addition to manually searching their reference lists.ResultsTen publications were identified describing a total of 29 subjects with a broad range of epilepsy disorders treated with closed-loop thalamic neurostimulation. The median age of subjects was 31 years old. Of the 29 subjects, 15 were stimulated in the anterior, 11 in the centromedian, and 3 in the pulvinar nuclei. Excluding 5 subjects who were treated for 1 month or less, median time on stimulation was 19 months. Of these subjects, 17/24 experienced greater than or equal to 50%, 11/24 least 75%, and 9/24 at least 90% reduction in seizures. Although a minority of patients did not exhibit significant clinical improvement by follow-up, there was a general trend of increasing treatment efficacy with longer periods on closed-loop thalamic stimulation.ConclusionThe data supporting off-label closed-loop thalamic stimulation for refractory epilepsy is limited to 29 adult and pediatric patients, many of whom experienced significant improvement in seizure duration and frequency. This encouraging progress must be verified in larger studies. (shrink)

Al-Fārābī's lost commentary on Aristotle's Ethica Nicomachea is without doubt one of the most sorely missed lost works of the Islamic falāsifa. In part, this is because the commentary was in some respects a scandal, and scholars accordingly believe it may hold the key to resolving present-day disagreements on how to interpret al-Fārābī's views as expressed in his independent treatises. Perhaps al-Fārābī's most shocking or scandalous statement is that preserved by the Hispano-Muslim philosophers Ibn Bājja, Ibn Ṭufayl, and Ibn Rushd. (...) According to them al-Fārābī says in his commentary on Aristotle's Ethica Nicomachea that happiness is to be achieved only in this life, not in the afterlife; that there is no happiness but political happiness; and that union with the active intellect – generally considered the highest goal of human existence by the philosophers – is impossible. This paper addresses the following questions: What exactly is the debate about? Why is the question of immortality or conjunction related to Aristotle's Ethica Nicomachea? And why was it so controversial to say, in the context of the Ethica Nicomachea, that there is no happiness but political happiness? Although the bulk of al-Fārābī's commentary is still lost, I have discovered two quotations of it in Hebrew manuscripts. As I will argue in this paper, these newly-discovered quotations – which are included with an English translation in the appendix – can shed light on the mysteries concerning al-Fārābī's commentary. Résumé Le commentaire perdu d'al-Fārābī à l’ Ethique à Nicomaque d'Aristote est sans conteste, parmi les ouvrages perdus de philosophes islamiques, l'un de ceux dont on regrette le plus l'absence. Cela s'explique notamment par le caractère à certains égards scandaleux de ce commentaire, dont les spécialistes attendent dès lors qu'il recèle la clé pour résoudre les désaccords actuels quant à l'interprétation à donner aux idées formulées par cet auteur dans ses traités personnels. La thèse peut-être la plus choquante ou scandaleuse d'al-Fārābī est celle qui est préservée par les philosophes hispano-islamiques Ibn Bājja, Ibn Ṭufayl et Ibn Rushd: selon eux, il affirme, dans son commentaire à l’ Ethique à Nicomaque, que le bonheur ne saurait se réaliser qu'en cette vie et non dans l'au-delà, qu'il n'y a pas de bonheur autre que le bonheur politique, et que l'union à l'intellect agent – généralement tenue par les philosophes pour être la fin suprême de l'existence humaine – est impossible. Cet article traite les questions suivantes: quel est exactement l'enjeu de ce débat? Pourquoi les questions de l'immortalité et de la conjonction sont-elles liées à l’ Ethique à Nicomaque? Et en quoi était-il si problématique d'affirmer, en référence à cette œuvre, qu'il n'y a pas de bonheur autre que le bonheur politique? Même si le corps du commentaire d'al-Fārābī est encore perdu, j'en ai découvert deux citations dans des manuscrits hébreux. Comme je le soutiens ici, ces citations récemment découvertes – données dans l'appendice avec leur traduction anglaise – font un peu de lumière sur les mystères du commentaire d'al-Fārābī. (shrink)

Le travail est consacré á la caractérisation de la théorie ď'argumentation créée par Perelman. Ce philosophe belge veut traitor la philosophie d’une façon ample, trouvant qu'elle doit aussi construire les principes de ľ'activité humaine, íl fáut que ces principes soient raisonnables et mútivés. Selon Perelman la logique contemporaine ne favorise pas сеs aspirations. Souvent elle est reduite à la logique formelle (A, Church, J. Bocheński), laissant en dehorn de ses intéréts ces moyens de raisonnemont qu’on applique a'laboration de la décision. (...) Perelman n'accepte pas ces conceptions, se reférant à Aristote. La théorie d ’argumentation proposée par lui, qu'on appelle rhétorique nouvelle, comprend ces techniques de raisonnement à l'aide desquelles on tend a faire accepter par l'auditoire donné la these présentée. Ces méthodes se trouvent à l'extérieur de la logique formelle et ne concement pas les situations dans les quelles on peut recourir a la vérification empirique. S'opposant au positivisme juridique, c'est-à-dire aux théories qui réduisent le droit à la loi, l'essentiel de son apport réside dans une théorie de l'argumentation qui rebat les cartes de la logique juridique, en mettant l'accent sur la manière de raisonner, et plus profondément de discuter. La vérité n'est plus chez Perelman une notion centrale. Elle est remplacée par l'idée d'adhésion, (...) qui permet de rendre compte du caractère progressif de l'assentiment. Loin d'une description désincarnée et décontextualisée, Perelman intègre une série de paramètres : qui parle, à qui, où, quand, dans quelle situation. Les arguments ne sont ainsi jamais totalement contraignants : c'est toujours le contexte qui conditionne leur acceptabilité. Un procédé comme la présomption d'innocence peut être compris, non comme une valeur fondamentale, mais comme un simple outil destiné à compenser l'absence de connaissance. Le droit apparaît ainsi comme un art de gérer les controverses. Cette vision s'inscrit dans une « philosophie du raisonnable » où la valeur d'une idée se mesure à sa capacité d'emporter l'accord des participants à la controverse qui naît de son introduction. Le domaine de l'argumentation est « celui du vraisemblable, du plausible, du probable, dans la mesure où ce dernier échappe aux certitudes du calcul". (shrink)

«Existe-t-il une argumentation juridique?», c’est la question à laquelle tente de répondre l’ouvrage de Stefan Goltzberg, intitulé explicitement L’argumentation juridique. Si l’auteur commence son ouvrage en posant directement la question, on en cherche aussitôt, par un réflexe de «juriste», la définition. Et il faut probablement lire l’intégralité de ce petit ouvrage pour voir se profiler une définition de l’argumentation juridique. Or, au cours de cette lecture Stefan Goltzberg nous montre en quoi chercher la définition, la poser, est déjà une marque (...) argumentative (p. 25) et certainement une marque de l’argumentation juridique. Or, Stefan Goltzberg n’est pas juriste de formation. This is a new edition, revised and expanded, of a seminal work in the logic and philosophy of time, originally published in 1968. Arthur N. Prior was the founding father of temporal logic. His work has attracted increased attention in the decades since his death: its influence stretches beyond philosophy and logic to computer science and formal linguistics. Prior's fundamental ideas about the logic of time are presented here along with his investigations into the formal properties of time and tense. (...) Already in 1969 Prior had been planning a new edition of Papers on Time and Tense, to incorporate his more recent work. Because of his untimely death this plan was never followed through--till now. Seven important papers have been added to the original selection, as well as a comprehensive bibliography of his work and an illuminating interview with his widow, Mary Prior, about his life and work. In addition, the Polish logic which made the original book difficult for many readers has been replaced by standard logical notation. This new edition will secure the classic status of the book. Ravelingien et al1 argue that, given the restrictions that must be imposed on recipients of xenotransplanted organs, we should conduct clinical trials of xenotransplantation only on patients in a persistent vegetative state. I argue that there is no ethical barrier to using terminally ill patients instead. Such patients can choose to waive their rights to the liberties that xenotransplantation would probably restrict; it is surely rational to prefer to waive your rights rather than to die, and permissible to allow patients (...) to make this choice.Perhaps the single most important advance in the history of moral thought occurred when it came to be generally recognised that all people are protected by rights that are inviolable, at least without their consent. The precise nature and content of these rights is controversial, but there is a consensus among reasonable people over their core. We all have a right to life, to liberty, to security of person and to equality before the law. Other rights—so-called positive rights, such as the right to economic security, or cultural rights, for instance—may be controversial, but we all agree at least on these.Ravelingien et al1 therefore seem to be on solid ground when they conclude that it would not be permissible to use living persons as subjects in clinical trials of xenotransplantation, as such trials, potentially or actually, result in the violation of the core human rights of the subjects. Their argument is as follows:" Xenotransplantation carries with it a currently unquantifiable risk of the transmission of viruses, from the animal that is the source of the organ transplanted, to the human recipient. Such viruses could have potentially catastrophic consequences, up to and including triggering a global and devastating pandemic. Avicenna holds that since God has existed from all eternity and is immutable and impassible, he cannot come to have an attribute or feature that he has not had from all eternity. He also claims for the simultaneous causation. A puzzle arises when we consider God’s creating this world. If God is immutable and impassible, then his attributes associated with his creating this world are unchanging. So, God must have been creating the world from all eternity. But then God’s creative (...) act, one might object, seems to be no different from a matter of natural necessity. This is a threat to divine freedom, for God would then have no choice concerning his creative action. Anthony Ruffus and Jon McGinnis argue that this puzzle can be solved in such a way that Avicenna can consistently affirm divine freedom along with divine simplicity. They suggest that Naṣīr al-Dīn Ṭūsī’s interpretation might help to show that it is false that Avicenna’s God cannot choose absolutely. For it is still open to him to choose either to create eternally or to refrain from creating anything at all. Ruffus and McGinnis argue that since creating or not creating anything at all do not correspond to two distinct concepts, Avicenna’s account of divine simplicity, which denies any multiplicity in divine mind, is safeguarded along with divine freedom. I claim that God’s omnirationality requiring that he always acts for reasons is a serious threat to such an interpretation. (shrink)

With the help of the natural history of “zero,” and the use of “zero” as a starting point, one may consider two types of metaphysics. On the one hand, the epistemological metaphysics, based on the perceptual/rational dichotomy, is related to the zero as a vacancy between numbers. On the other hand, the genetic metaphysics, based on the dichotomy of source-evolution, has much to do with the zero as a number between negative and positive numbers. In this respect, zero represents the (...) horizon of metaphysics: we can forever approach it, but we cannot ultimately arrive at it. Though serving as the point of convergence and divergence for all relationships, zero has no definable content of its own. Such is the essence of zero, and of metaphysics as well. (shrink)

El libro pone de relieve el modo en que el sector liberal-conservador más poderoso, con sede en Oxford, ha construido la ficción en torno a la figura de Isaiah Berlin. Sir Isaiah Berlin es conocido como una lumbrera del pensamiento político del siglo XX, uno de los máximos exponentes intelectuales del liberalismo democrático, un pensador moralmente comprometido con la causa de la libertad y (...) la lucha contra el totalitarismo. El lector podrá comprobar que la imagen que se atribuye a Isaiah Berlin es una mitificación, una ficción forjada con el propósito de defender una serie de intereses académicos (y reforzar así la marca Oxford), políticos (en torno al sector liberal-conservador anglosajón) y nacionales (al objeto de cantar la leyenda de una Corona británica comprometida –así dicen– por la defensa de la democracia Occidental). Como Research Fellow en la Universidad de Oxford, el autor ha tenido oportunidad de examinar esta realidad y ver con sus propios ojos cómo los liberal-conservadores fabrican sus mitos. Las conclusiones de este estudio no dejarán indiferentes ni a académicos –principalmente, del área de Historia de las Ideas, y Teoría Política y Moral–, ni a escritores y políticos como el Premio Nobel Mario Vargas Llosa o la marquesa Cayetana Álvarez de Toledo, auto-denominados liberal-conservadores, porque derrumba un pilar de su religión.
